Wauwatosa PD sued for detaining black teen mistakenly thought to be carjacking white grandmother
WAUWATOSA, Wis. (CBS 58) — The Wauwatosa Police Department is being sued for violating the civil rights of a black man during a traffic stop last year.
The 18-year-old was handcuffed and detained because officers thought he was carjacking his white grandmother.
The two of them, plus the grandmother’s friend who was also in the car, filed the lawsuit.
In a statement, the department says two people had flagged down officers to point out a carjacking happening nearby. On squad car dash camera video, the woman can be heard confirming the man in the backseat is her grandson.
The man was held in the back of a squad car for about six minutes. “I’m guessing what this sounds like is a big misunderstanding,” one of the officers says to him. Police say the man was detained based on reasonable suspicion.
The lawsuit says it wasn’t reasonable, and that there’s never been proof the officers were flagged down about any carjacking. The plaintiffs are claiming damages including “severe emotional pain, distress and the loss of enjoyment of life,” among others.
They believe it was a “racially-motivated vehicle stop,” and the man “re-lives that terror every day.” A witness, Dominique Elliott, recorded cell phone video of the incident.
“They shouldn’t have gone that far,” he said. “If you would have seen how surrounded this boy was, and I was just thinking oh my God, I hope they don’t kill him.” The lawsuit says the Wauwatosa police chief has refused to do a formal investigation of the incident.

Heavy rain causes setbacks for Kenosha County farmers
KENOSHA COUNTY, Wis. (CBS 58) — The rain this week means more trouble for farmers in Kenosha County.
The owners of Jerry Smith’s Pumpkin Farm, Joe and Amy Smith, said they got about half an inch of rain in less than half an hour Tuesday. It’s been a wet season for them.
The Smiths closed their family attractions on the opening weekend because of rain. They’ve had to close at least one day every weekend since then.
“It’s such a short season for us that every day you lose, you don’t get back,” Joe Smith said. His wife, Amy, said it’s been frustrating.
“You hope that the weather’s on your side, and really it’s all up to the good Lord,” she said. All the water has severely damaged large areas of pumpkins in the Smiths’ fields. Amy says it’s not just pumpkin farmers like her family suffering. It’s all farmers.
“This spring, there were lots of fields that didn’t get planted,” she said. “What are the cows going to eat? It’s kind of scary if you think about it. Your food chain is getting smaller and smaller.”
Amy didn’t want to make it sound like she was complaining though. She said when times are good, her profession is extremely rewarding. She says maybe her children will eventually see that because right now, they don’t want to go into the family business.
