Sharon Otieno murder case: Governor Obado Released on a Bail of Ksh.5million, Pre-Trial set for 2019

Migori Governor Okoth Obado has been freed on a Ksh.5million bail after spending almost a month in remand prison.
Conditions to be adhered to by Obado
Obado is also expected to pay two sureties of a similar amount and avoid going anywhere near the murder scene.
“He shall not go anywhere within 20Kms of Homabay County boundary on all sides of that county,” Justice Jessie Lessit warned.
She further directed that Obado should not skip any court session as his bail could be revoked at any time.
The Migori Governor was charged over the murder of Rongo University student Sharon Otieno on September 24. On Wednesday, Lady Justice Lessit further warned Obado against communicating with the parents, siblings or rather any close relative of the deceased.
“The accused will refrain from contacting or intimidating whether directly or by proxy witnesses in this case,” she said, adding that he should not discuss the case in a political meeting or private gathering.
The Prosecution stated that they would be calling 30 witnesses in the case.
The High Court judge further directed Obado to deposit travel documents and be reporting to the deputy registrar once a month.
Okoth Obado Trial 2019
The pre-trial hearing has been set for February 14, 2019.
The hearing will then commence on May 6-17 the same year excluding Saturdays and Sundays. His co-accused Michael Oyamo and Caspal Obiero were however denied bail. Justice Lessit however said they have the right of appeal for bail or bond. Earlier on Wednesday morning, supporters of Obado were locked out of the court compound.

Sharon Otieno murder case: Obado taken to hospital after falling ill

Migori Governor Okoth Obado was taken to the hospital on Wednesday after becoming ill in remand.
The governor was admitted to Kenyatta National Hospital’s private wing at around 12pm, acting Clinical Services Director Dr Peter Masinde confirmed.
“He is sick, but not in critical condition,” Dr Masinde said, adding that he is not allowed to give details of what the governor is suffering from.

Mr Obado has been in police custody at the Industrial Area Remand Prison in Nairobi from last week after he was charged with the murder of Rongo University student Sharon Otieno.

Migori Governor Okoth Obado to be remanded at Industrial Area GK prison for 11 more days after High rejected his application for bail on Thursday.
Judge Jessie Lessit ruled that the High Court was obliged to deny him bail on accounts of public influence, security and possible interference with the witnesses accounts.
Obado together with the two other suspects; his personal assistant Michael Oyamo and Caspel Obiero, a clerk at the Migori County Assembly are set to appear before the court on October 8, 2018.
Reading the ruling, Judge Lessit explained that the only way the court can ensure the case is not interfered with is by having the accused in police custody.
“We cannot release the accused as others are being arrested, at this stage, I am disallowing the application,” ruled Judge Lessit.
Obado who is facing murder charges following the gruesome killing of pregnant Rongo University student was remanded on Tuesday for two nights at the Industrial Area GK Prisons following an order by Lady Justice Jessie Lessit.
According to the Directorate of Criminal Investigation’s report, Obado was to be charged with the offence of aiding and abetting the commission of felony, charges he was keen to deny.
Earlier his lawyer Cliff Ombetta promised that his client, Obado, would comply with all the orders of the court. He urged the court that he could not influence the witnesses if released on bail.
“Yes, he (Obado), the accused, is a man of influence; this is just political and not the case. He will not, in way, if granted bail, influence the witnesses,” argued Ombeta.
However, in Thursday’s ruling, Judge Lessit, ruled Obado being a Governor and a man who rose to power through politics he has a likelihood of interfering with witnesses’ accounts.
The prosecution had earlier argued that Sharon’s family is being threated, they claimed that the defence watered on arrival.
“No OB number has been produced. Who is family? Somebody specific must have been threatened! The court cannot speculate, the court cannot imagine, the court cannot assume, the court must see,” argued Ombeta. “My client can’t be accused of murder. He only performed his manly duties- a biblical fulfilment, a societal happiness and an expansion of the ecosystem. Is impregnating a woman murder?” Cliff wondered.

Sharon Otieno murder case: Okoth Obado’s low life at Gigiri Police Station

Migori Governor Okoth Obado shared cells with a suspect in the shooting of former Garissa County Finance Executive Idris Muktar, five Kenya Revenue Authority officials and those from the Kenya Ports Authority who were arrested on Friday.
And just like any other detainee, the governor was not accorded any special treatment at the Gigiri Police Station cells.
He slept on the floor with no mattress, ate what the rest of the remandees ate and took a shower at the cells’ bathrooms.
Over the weekend, Sharon Otieno’s boyfriend was dressed in heavy casual clothing— including socks and a hoodie to shield him from the cold and mosquitoes.
On Sunday morning, Mr Obado and the other inmates took tea and three slices of bread and had a meal of rice, beans and cabbages for lunch.
Okoth Obado wife visited him
Only his wife Hellen, son and lawyers Rodgers Sagana and Cliff Ombeta were allowed to visit him, with sources telling the Nation that police officers restricted the duration of visit and listened to their conversations.
The media, visitors from Migori County and some lawyers were not allowed to see the governor who was rumoured to have fallen sick on Saturday.
“The governor is fine. He is healthy and has not fallen ill or taken anywhere for any treatment,” Lawyer Cliff Ombeta said after visiting him.
Gigiri police chief Richard Muguai also dispelled rumours that Mr Obado had collapsed and taken to hospital.
The governor, he said, had not shown any signs of being ill.
Mr Obado will, together with four other people, be arraigned at the Milimani Law Courts midmorning today, in connection to the murder of Ms Otieno.

Obado’s account frozen over graft

Obado was again o the spot again after it emerged that detectives have been persuing what is believed to be suspicious transfers of county funds to his children in abroad. Among accounts frozen is Hellen Adhiambo Odie (Obado’s wife), five businessme ad three companies believed to be associated with the governor.
The other named as the governor’s associates who have benefited from the alleged fraudulent deals and whose accounts have been frozen include Jared Peter Odoyo Oluoch Kwaga, Ernest Omondi Owino and Joram Opala Otieno.
Also Patroba Ochanda Otieno, Beatrice Akinyi Ogutu, Kennedy Odhiambo Akello and Kennedy Onyango Adongo.

Sharon Otieno murder case: Okoth Obado arrested and to spend weekend in police cell

Migori Governor Okoth Obado is set to be arraigned on Monday over the murder of Rongo University student Sharon Otieno.
Police say Mr Obado will spend the weekend at Gigiri Police Station.
The governor was arrested early Friday and questioned on the murder of Ms Otieno at the headquarters of the Directorate of Criminal Investigations (DCI) on Kiambu Road in Nairobi.
“We were asked to present ourselves to the DCI but they arrested him. The line of questioning was on murder,” his lawyer Cliff Ombeta said.
The police have linked Obado to the murder of the seven-month-pregnant Rongo University medical statistics student after DNA analysis revealed he was the father of the unborn baby.

The foetus died after the mother was stabbed in the abdomen with the blow tearing through it.
On September 11, 2018, Governor Obado alongside his personal assistant Michael Oyamo and journalist Barrack Oduor were questioned by the DCI detectives for the first time since Sharon’s brutal murder. Obado joins five other suspects including his personal assistant Oyamo, bodyguard Elvis Omondi and a clerk in the county Caspal Obiero who are in police custody over the brutal murder and abduction of Barrack Oduor.

Mrs. Hellen Obado, the wife to Migori Governor appeared before the DCI officials over the death of Sharon Otieno, who was believed to be carrying Governor Obado’s child at the time of her gruesome murder.
Mrs Obado was alleged that she was in communication Sharon over her alleged affair with her husband. Naftali Odie, her brother is also a person of interest in the ongoing investigations.

Zachary Okoth Obado is a Kenyan politician and currently the Governor for Migori County. He is a member of People’s Democratic Party (PDP) and a coalition member of Coalition for Reforms and Democracy.
He is a trained teacher and was formerly the Director of Kenya Sugar Board (KSB).In Kenya’s 2013 general election, John vied in the gubernatorial elections, winning as Governor of Migori County, alongside Deputy Governor Nelson Mahanga Mwita. He was elected on a PDP party ticket.
His election was petitioned by Prof Oyugi who was vieing on an ODM ticket which made the High court to order for a recount of votes and saw the vote margin rise from 163 to 577, with Mr Obado still the winner ,Prof Oyugi disagreed. He appealed the decision maintaining that scrutiny of all votes showed he won by 174 votes. Mr Obado and the electoral commission asked judges to adopt an argument by the High Court, that an election is not a mathematical puzzle.
The IEBC said there was no election ever held that was 100 per cent flawless. On 23th April 2014, he was reinstatited as the governor for Migori county.
