Nick Sandmann Defamation Lawsuit
The Sandmann family hired attorneys who filed a US$ 250 million defamation case against The Washington Post on behalf of Sandmann in February 2019. The complaint accuses the Post of publishing seven “defamatory and misleading posts.”
The complaint alleged that the Post wanted to lead a “mainstream and social media mob of bullies that attacked, vilified, and threatened” Sandmann, that the Post wrongly targeted and bullied Sandmann “because he was the white, Catholic student wearing a red ‘Make America Great Again’ souvenir cap on a school field trip” and that the Post “knew and intended its allegedly defamatory accusation” The Washington Post settled the case on July 24 , 2020 with Nick Sandmann. The complete settlement has not been released.
The case against The Washington Post was initially dismissed on 26 July 2019 because the arguments of the plaintiff that he was wrongly accused of racial acts “is not backed by the plain language of the paper,” and that even the published content was an opinion, covered by the First Amendment. After the lawsuit was revised by Sandmann’s attorneys, the suit was revived on 28 October 2019.
The judge stood by his earlier decision that 30 of the Post’s 33 statements challenged by the lawsuit were not libelous, but decided that three statements that “say that (Sandmann) ‘blocked’ Nathan Phillips and ‘would not allow him to withdraw'” warranted further scrutiny.”
