The 77-year-old impresario – who claims he was cheated out of the rights to the $40 million musical Dirty Dancing – tipped himself into bankruptcy on June 24, with debts of more than $2 million.
Kevin made the move as Mr. Joye’s company was trying to bankrupt him and his wife Billie over $5,643 in court costs from an earlier family dispute over box office proceeds from the show.
The brothers had once shared rights to the musical, but Mr. Jacobsen claims that none of the profits are flowing to him because he has been unfairly cut out of the family company. However, Mr. Joye denies the claim.
Mr. Jacobsen alleges he was removed as a company shareholder after a falling out between the two brothers in May 2007. The dispute arose after Kevin’s son Michael and Col’s daughter Amber joined the business. The children were elevated to board positions which threatened to destroy all that the family has built up since the brothers were in the hit pop group the Joy Boys.
The brothers and their now-adult children have spent years warring over the lucrative musical, which produced $40 million a year in royalties at its peak. The two families also owned the Vector Arena in Auckland together, once worth $14 million.
They have battled it out in the British High Court and in the US, as well as at courts in Australia. Mr. Jacobsen obtained the worldwide rights to the Dirty Dancing show because of his close relationship with the American writer of the film, Eleanor Bergstein.

Malcolm is based in the US, where he flies for an American commercial airline, had put off having the DNA test for a year because he was “fearful of the results”.
“When I finally did one I asked my dad to not tell me the outcome but that eventually came out: My dad who brought me up as his own son was not my biological father. After everything he did for me, I wasn’t his. That destroyed him and devastated me.
“I approached my mother to find out who my biological father was and in August last year, she told me that it was Col Joye,” he claimed. Since then the Australian artist has allegedly turned down requests to have a DNA test and has not contacted Malcolm.
“I’m disappointed that he hasn’t tried to contact me in any way,” he said. “I don’t know anything about his medical history. It would also be nice to get to know him.”

Joye grew up in quite a financially struggling family which forced him and his brothers to work in order to make ends meet. His first job was jewelry salesman back in 1951 after he left school. Six years later, Col and his brothers started playing rock and roll dances in movie theatres in Sydney, Australia. With time, more people joined the Jacobsens, and eventually, they formed the KJ Quintet band.
